End User License Agreement (EULA)

1. Agreement Scope

This End User License Agreement ("EULA") governs your purchase and use of downloadable PlasticTouch animation files ("Licensed Content"). By purchasing a License, you ("Licensee") agree to these terms.

Note: This EULA applies ONLY to License purchases (one-time payment for downloads). For streaming subscriptions (Consult, Clinic), see the Terms of Service.

2. License Grant

Upon full payment, PlasticTouch grants Licensee a perpetual (lifetime), non-exclusive, non-transferable license to use the Licensed Content for commercial purposes within one practice or organization ("Practice").

2.1 Definition of "Practice"

Practice means a single legal entity or individual practitioner. If you operate multiple clinics under separate legal entities, each entity requires its own license.

2.2 Permitted Uses

You may use the Licensed Content for:

• Website: Hosting on your clinic website (self-hosted or embedded)
• Social Media: Sharing on Instagram, Facebook, YouTube, TikTok, etc.
• Advertising: Use in paid ads, marketing campaigns, and promotional materials
• Presentations: Patient consultations, conferences, webinars
• In-Office Display: TV screens in waiting rooms, examination rooms (offline or self-hosted player)
• On-Site Screens: Digital signage within your Practice locations

2.3 Modifications & Branding

You may make reasonable modifications to the Licensed Content for branding purposes, including:

• Adding your clinic logo, watermark, or contact information
• Trimming video length for specific use cases
• Adding background music or voiceover (in compliance with music licensing laws)

Restriction: You may NOT alter the medical content or procedure depiction in a way that changes its medical accuracy or creates misleading information.

3. Restrictions

3.1 Prohibited Activities

You may NOT:

• Redistribute or Resell: Share, sell, or transfer the Licensed Content files to third parties
• Sublicense: Grant sublicenses to other practices, organizations, or individuals
• Stock Library Use: Include the Licensed Content in stock video libraries or asset marketplaces
• AI Training Datasets: Use the Licensed Content to train machine learning or AI models without explicit written consent from PlasticTouch
• Misleading Claims: Use the Licensed Content to suggest guaranteed outcomes or make false medical claims that violate advertising regulations

3.2 Geographic & Practice Scope

The license is limited to the Licensee's Practice. If you have multiple Practice locations under the same legal entity, the license covers all locations of that entity. Separate legal entities require separate licenses.

4. Intellectual Property

PlasticTouch retains all copyright, trademark, and intellectual property rights to the Licensed Content. This license grants you usage rights only, not ownership.

5. 30-Day Complimentary Clinic Trial

License purchases include a 30-day Complimentary Clinic Trial for watermark-free streaming access and clinic tools.

Trial Benefits:

• Stream any PlasticTouch animation without watermarks
• Access Progressive Web App (PWA) for library management
• Share branded video links
• Generate website embed codes for verified domains
• Access TV Waiting Room with Explainer Mode

Trial Limitations:

• Trial provides full Clinic tier access for 30 days
• After 30 days, streaming reverts to watermarked viewing and clinic tools lock
• Download access remains perpetual under this EULA

6. Medical & Outcome Disclaimers

MEDICAL DISCLAIMER: The Licensed Content is for educational purposes only and does not constitute medical advice, diagnosis, or treatment recommendations.

• Clinical outcomes are not guaranteed; individual results vary
• Licensee is solely responsible for ensuring compliance with all applicable medical regulations and advertising standards
• PlasticTouch is not liable for any medical outcomes, patient complications, or regulatory violations resulting from use of the Licensed Content

7. Termination for Breach

This license may be terminated immediately if Licensee:

• Violates any term of this EULA
• Engages in redistribution, resale, or sublicensing of the Licensed Content
• Uses the Licensed Content in violation of applicable laws or regulations

Upon termination, Licensee must immediately cease all use of the Licensed Content and delete all copies.

8. Audit Rights

PlasticTouch reserves the right to audit Licensee's use of the Licensed Content upon reasonable notice to ensure compliance with this EULA. Audits will be conducted in a manner that respects Licensee's privacy and business operations.

9. Warranty Disclaimer

THE LICENSED CONTENT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. PLASTICTOUCH DOES NOT WARRANT THAT THE LICENSED CONTENT IS ERROR-FREE, COMPLETE, OR WILL MEET YOUR SPECIFIC REQUIREMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLASTICTOUCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE LICENSED CONTENT.

PLASTICTOUCH'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE LICENSE.

11. Governing Law

This EULA shall be governed by the laws of Serbia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Belgrade, Serbia.
