Terms of Service

1. Acceptance of Terms

By accessing and using PlasticTouch ("Service"), you ("User", "you") accept and agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with these Terms, you must not use this Service.

2. Service Plans & Definitions

2.1 Free Plan

Free users may stream all PlasticTouch animations with a visible watermark. Free users may share links to videos (which will display with watermark) but have no right to download, embed on external websites, or use TV Waiting Room features.

2.2 Consult Subscription ($19/mo, $228/year)

Consult grants a non-exclusive, non-transferable, revocable right to:

• Stream and view all PlasticTouch animations without watermarks
• Share branded video links with custom logo (if uploaded)
• Access the Progressive Web Application (PWA) for library management and sharing

Consult does NOT include:

• Download rights for video files
• Website embed code generation
• TV Waiting Room / Explainer Mode access
• Commercial redistribution, re-upload, or public broadcasting beyond authorized sharing channels

2.3 Clinic Subscription ($99/mo, $1188/year)

Clinic includes all Consult benefits PLUS:

• Website Embed: Generate per-video embed code for one verified domain (additional domains available as add-on). Embeds must comply with domain whitelisting and referer guards.
• TV Waiting Room: Access to Explainer Mode kiosk player for in-clinic displays with custom slide editing.
• Branded Links & Logo: Custom logo branding on shared links and embeds.

Restrictions: Embed playback is restricted to verified domains only. Unauthorized embedding, deep-linking of tokens, or circumventing technical protections is strictly prohibited. No download rights for video files.

2.4 License (One-Time Payment, Perpetual)

Licenses are covered under the End User License Agreement (EULA). License purchases grant:

• Perpetual download access to purchased animation files (MP4/ZIP)
• Commercial use rights for the purchased animation (details in EULA)
• 30-day Complimentary Clinic Trial (watermark-free streaming, Website Embed, and TV Waiting Room features)

After the 30-day trial expires, streaming reverts to watermarked viewing and clinic tools lock unless subscribed. Download access remains perpetual.

2.5 Complimentary Trials

30-Day Signup Trial (Clinic Access)

All new signups receive a 30-day complimentary trial with full Clinic access. This trial:

• Grants watermark-free streaming, Website Embed code generation, TV Waiting Room, branded patient links, and analytics
• Requires no credit card or payment information
• Automatically expires after 30 days, reverting to Free tier (watermarked streaming)
• Does NOT automatically renew or charge
• Cannot be extended or reactivated for the same account

30-Day License Purchase Trial (Clinic Access)

Users who purchase any License receive a 30-day complimentary trial with full Clinic access. This trial:

• Grants watermark-free streaming, Website Embed, TV Waiting Room, and all clinic tools
• Automatically activates upon License purchase
• Expires 30 days after License purchase date
• Reverts to Free tier after expiration (download access remains perpetual)
• Does NOT automatically convert to paid subscription

Important: Both trial types provide identical Clinic feature access. Trials are promotional only and do not establish recurring billing. Users must manually subscribe to Consult or Clinic before trial expiration to maintain clinic tool access.

3. Usage Restrictions (Streaming Plans)

3.1 Streaming vs. Download Rights

Streaming plans (Free, Consult, Clinic) provide streaming-only access. Users on streaming plans:

• Cannot download video files — Streaming content is for online viewing only
• Cannot use in paid advertising — Social media ads, billboards, or any paid promotional materials require a License
• Cannot edit or alter video files — No permission to modify the animation content itself (custom overlays and slides in Clinic are separate clinic-created content)
• No ownership transfer — Streaming access does not grant ownership or perpetual rights to the video assets

3.2 Prohibited Activities

Users are strictly prohibited from:

• Downloading or attempting to download streaming content (screen recording, ripping, capture tools) for redistribution
• Removing, obscuring, or modifying watermarks on Free plan content (Consult/Clinic users can display their own branding per plan features)
• Repackaging, sublicensing, or redistributing PlasticTouch player or embed codes
• Deep-linking embed tokens or sharing tokens beyond authorized domains
• Hosting embed players on third-party platforms not verified by PlasticTouch
• Using animations in contexts involving hate speech, illegal practices, false medical claims, or deceptive advertising
• Using animations in training datasets for AI/ML models without explicit written consent

3.3 Embed & TV Waiting Room Restrictions

Embed functionality is available only to Clinic subscribers and must comply with:

• Domain Verification: Embeds work only on domains you own and have verified via META tag
• Referer Guards: Embeds include strict referer and domain whitelist checks; circumventing these is prohibited
• TV Waiting Room: Kiosk links are institution-specific and must comply with local healthcare regulations

4. Medical Disclaimer & Clinic Responsibility

IMPORTANT: All content on PlasticTouch is for educational purposes only and does not constitute medical advice, diagnosis, or treatment recommendations.

• PlasticTouch animations do not replace professional medical judgment, training, or regulatory compliance
• Clinical outcomes are not guaranteed; individual results vary
• Healthcare providers are solely responsible for clinical decisions and patient care
• Users must comply with all applicable local, state, and federal medical regulations
• Clinic-Controlled Content Liability: PlasticTouch content is educational only. Clinics are responsible for ensuring that any messaging, overlays, captions, translated text, or modified slide content displayed in their waiting room, website embeds, or patient-facing links complies with local regulations and is accurate for their specific patients and procedures. PlasticTouch is not liable for clinic-created or clinic-modified content, including custom slides, recovery instructions, pricing/financing information, promotional materials, or multilingual translations.

5. "Verified by Surgeons" Disclaimer

The designation "Verified by Surgeons" indicates that content has undergone professional review by qualified medical practitioners at the time of verification. This does NOT:

• Constitute a guarantee of medical accuracy or outcomes
• Create a doctor-patient relationship between PlasticTouch and end users
• Replace independent professional verification by healthcare providers

6. Logo & Branding Rights

Consult and Clinic users may upload custom logos for branded sharing, embeds, and waiting-room TV displays. By uploading a logo or custom branding, you represent and warrant that you have all necessary rights to use said logo and branding materials.

Branding Flexibility: Consult and Clinic subscribers can display their own clinic logo in patient-facing materials (share links, website embeds, and waiting-room TV displays). PlasticTouch branding is not required on these clinic-controlled surfaces.

PlasticTouch may display customer names and logos in public-facing customer lists or case studies only with prior written consent.

7. Payments, Auto-Renewal & Cancellation

7.1 Subscription Billing

Consult and Clinic subscriptions auto-renew at the end of each billing cycle (monthly or annual) unless canceled. You may cancel at any time through your Account Settings. Cancellation takes effect at the end of the current billing period.

7.2 Refund Policy

All subscription fees are non-refundable after activation, except where required by applicable law. License purchases are non-refundable once download access has been granted.

7.3 Price Changes

PlasticTouch reserves the right to modify subscription pricing with 30 days' advance notice to existing subscribers. Price changes apply to renewals after the notice period.

8. Service Modifications & Availability

PlasticTouch reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with reasonable notice. We do not guarantee 100% uptime or availability.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLASTICTOUCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

PLASTICTOUCH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO PLASTICTOUCH IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless PlasticTouch from any claims, damages, or expenses arising from:

• Your use of the Service in violation of these Terms
• Content you upload (logos, Explainer text slides, etc.)
• Your violation of any third-party rights

11. Anti-Circumvention

You may not attempt to bypass, disable, or interfere with any technical protection measures implemented by PlasticTouch, including but not limited to:

• Embed domain whitelisting and referer guards
• Rate limits on API endpoints
• Share token expiration and validation

12. Acceptable Use Policy

You agree NOT to use PlasticTouch content in connection with:

• Hate speech, discrimination, or promotion of violence
• Illegal medical practices or unlicensed healthcare provision
• False or misleading medical claims
• Deceptive advertising or fraudulent schemes

13. Intellectual Property

All PlasticTouch animations, graphics, logos, and trademarks are the exclusive property of PlasticTouch or its licensors. Your subscription or license grants you limited usage rights as described herein but does NOT transfer ownership.

14. Governing Law & Jurisdiction

These Terms shall be governed by the laws of Serbia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Belgrade, Serbia.
